Terms & Conditions
The terms that apply to this website and to estimates, proposals and work performed by Grace Construction.
Last updated: August 2026. These terms apply to the use of gracecons.com and to estimates and proposals issued by Grace Construction. Where a signed contract exists for a specific project, that contract governs and takes precedence over anything on this page.
1. Who we are
Grace Construction (also trading as Grace Construction Group) is a fence and outdoor living contractor based at 9820 County Road 514, Alvarado, Texas 76009. You can reach us on 682-456-8200 or at contact@graceconstructiongroup.org.
2. Using this website
The content on this site is provided for general information about our services and service area. Photographs of completed work are shown to illustrate the kind of construction we do; materials, stain colour, grade and site conditions vary from project to project, so no image on this site should be read as a guarantee of a specific result on your property.
You may not copy, republish or reuse the text, photographs or layout of this site for commercial purposes without our written permission.
3. Estimates and proposals
Estimates are free and carry no obligation. An estimate becomes binding only once it is issued as a written proposal and signed by both parties.
Every written proposal states its own validity period. Material prices — cedar, pipe, ornamental iron, concrete and hardware — move with the market, so a proposal that has expired may need to be re-priced before work is scheduled.
Quantities are taken from an on-site measure. Where a property line is unclear, disputed or not marked, the measure is based on what is visible on the day. Confirming the true boundary, and resolving any dispute with a neighbour, is the property owner’s responsibility.
4. What a proposal includes
Unless the proposal says otherwise, our pricing covers materials, labour, tear-out of the existing structure, removal of old post concrete and haul-off of debris. Anything not written into the proposal is not included.
Items that commonly fall outside a standard scope include: rock excavation or drilling where auger refusal occurs, relocation of sprinkler lines, utility conduit or landscaping, retaining or grade work not specified, engineered drawings, and repairs to pre-existing structures we did not build.
5. Permits, HOA approval and utilities
Where a city permit or HOA submittal is required, we will tell you at proposal stage and, where the proposal says so, prepare and submit it. Approval itself rests with the city or the association, and we cannot control how long it takes or whether it is granted.
We request public utility locates before digging, as required in Texas. Public locate services do not mark private lines — sprinkler systems, landscape lighting, gas runs to a grill or pool equipment, invisible pet fencing and similar. Please point these out before we start. We are not responsible for damage to unmarked private lines, though we will always tell you immediately if we hit one.
6. Scheduling and weather
Start dates are scheduled in good faith. Fence and concrete work in North Texas is weather dependent: we do not set posts in saturated ground or pour in conditions that will compromise the cure. Rain delays move a schedule and are not grounds for cancellation or price reduction.
7. Payment
Payment terms are stated on each proposal. A deposit is typically required to schedule the work and order materials, with the balance due on completion and walk-through. Custom fabricated items — drive gates, ironwork and welded pipe entries — may require a larger deposit because they are built to your dimensions and cannot be restocked.
Work is considered complete when the structure is built and the site cleaned, not when a stain has fully cured or an HOA has finished its own review.
8. Changes to the work
Any change to the agreed scope — added footage, an extra gate, a different picket profile, a relocated line — is priced and agreed in writing before it is carried out. Verbal changes are not binding on either party.
9. Workmanship and materials
We stand behind our installation. If a structure we built moves, sags, or fails because of how we installed it, we will come back and put it right. The specific warranty period and what it covers are stated on your proposal.
Wood is a natural material and behaves like one. Cedar and treated pine will check, cup, colour-shift and move seasonally with humidity; this is normal and is not a defect in workmanship. Staining is a maintenance finish, not a permanent coating, and will need renewing periodically. Our warranty does not cover normal weathering, storm, flood, vehicle impact, ground movement outside normal seasonal range, damage by third parties, or alterations made by others after we hand over.
10. Cancellation
You may cancel before work begins. Where materials have already been purchased or custom items fabricated to your specification, those costs are payable. Texas law gives you a three-day right to cancel certain contracts signed at your home; where that right applies, it is set out in the contract you sign.
11. Limitation of liability
Nothing here limits liability that cannot lawfully be limited. Beyond that, our liability arising out of a project is limited to the amount paid to us for that project, and we are not liable for indirect or consequential losses.
12. Governing law
These terms are governed by the laws of the State of Texas, and any dispute falls to the courts of Johnson County, Texas.
